Alternative dispute resolution: a win-win solution? The magistrate's point of view.
Beyond the obligation of principle enshrined in the Code, the conciliation mission entrusts the expert with a subtle and complex role. It goes beyond the simple
technical expertise to a more human and diplomatic dimension: the expert becomes a potential vehicle for dialogue and appeasement between parties in conflict. But how, and above all when, can they intervene to help resolve a dispute, while respecting the objectivity, impartiality and neutrality essential to their role?
The expert, aware of his responsibility to inform and clarify, can seize opportune moments to encourage constructive communication. During discussions, without ever stepping outside his analytical framework, he can suggest ways of understanding each other, recalling the facts with a precision that encourages mutual listening. It is in this discreet mediation posture, based on methodical rigour, that the expert can subtly influence the dynamics of the conflict, inviting the parties to envisage a more serene and shared outcome.
The conference will look at the alternative dispute resolution methods encouraged by judges to lighten the load of legal proceedings and promote mutually beneficial agreements. It will explore the role of the judge in these processes, particularly in encouraging the parties to engage in dialogue and find common ground. Experts will discover tools and techniques to help parties reach an amicable resolution, while respecting fairness and the interests at stake.
The lecture will be given by Avi Schneebalg, Justice of the Peace and honorary lawyer, lecturer in negotiation, conciliation and mediation.
